The Supreme Court is about to tackle their newest case between gay rights and the freedom of religion. The case is being brought to trial because a cake baker wouldn’t make a cake for a same-sex couple from Colorado.
The Justices have decided they will take the case and decide if the baker has rights to refuse to bake the cake. The case has challenged both aspects of religious freedom and discrimination. The judges will look into the baker’s religious freedom and the couple’s equal treatment under the law to see who is right. The intersection is you shouldn’t be forced to do something that violates your religious beliefs but, when does that become discrimination.
This is definitely not the first case of this kind to come up to the Supreme Court, but it is the first in a long while. The fact that the Justices decided to take this case is clear evidence that they are ready with new energy. This likely comes from the fact that they added Justice Neil Gorsuch to the Court.
The baker, Jack Phillips, allegedly discriminated against a homosexual couple according to Colorado law. If Phillips can prove he has free speech and religious rights under the First Amendment then he should win the case. Phillips has not wavered from the fact that he believes he shouldn’t be forced to make a cake in any scenario.
According to the Associated Press, the Colorado anti-discrimination law does the following, “Colorado’s anti-discrimination law protects people on the basis of their sexual orientation.”
