An angry Australian Vegan is suing her neighbor due to the smells that their outdoor grilling has caused to waft into her yard, according to 9 News.
Cilla Carden, a suburban dwelling massage therapist, has taken her neighbors all the way to the nation’s Supreme Court, demanding that they stop various unacceptable activities, including smoking, children bouncing balls and holding barbecues in their backyard.
Carden’s claims were reportedly heard at a tribunal in January this year, but they sided with her neighbors and dismissed every claim.
Carden then applied to the Supreme Court for the right to appeal the Tribunal’s decision, but that was also denied in July. However, she has been clear that she plans to keep fighting for her right to meat aroma free air.
“They’ve put it there so I smell fish, all I can smell is fish. I can’t enjoy my backyard, I can’t go out there,” Carden said according to 9 News.
“It’s been devastating, it’s been turmoil, it’s been unrest, I haven’t been able to sleep,” she said.
Carden is suing Toan Vu, who lives next door with his wife and children, since late 2018, according to The DailyMail.
“According to documents seen by Daily Mail Australia, she also demanded Mr and Mrs Vu control the weeds in their garden, repaint common fences and repay the cost of plants damaged on common property,” the DailyMail reported.
“It’s deliberate, that’s what I told the courts, it’s deliberate,” Carden said.
However, Vu said that he has removed the barbecue from his yard and had banned his children from playing basketball in their yard as well.
However, according to the DailyMail, the pair may have reached an agreement, out of court:
“The applicant has reached agreement with Mr Vu that positioning his barbecue on Unit B over away from [Ms Carmen’s] Unit C, closer to unit 18A, is acceptable to the applicant,” a court document read, according to the DailyMail.
